How Long Do I Have To File An Injury Claim After An Accident?

If you’ve recently been injured in a car wreck, you may be wondering how much time you have to hire a personal injury attorney and file a claim for damages. In Connecticut, the statute of limitations for personal injury claims is two years if your injury was caused by another individual. In Rhode Island, you have three years after the date of the car accident to file your claim. In some cases, where an injury took a while to present itself, you might be able to extend the two years from the date you discovered the injury, instead of the date the accident took place.

If your auto accident was caused by a government entity, such as public transportation or a poorly maintained road, you only have six months to file a personal injury claim. In either case, time is of the essence. Call TJC • ESQ has soon as possible after an accident to give your case the best chance!

Can I Still Recover Damages If I Am Partially At Fault?

It is not uncommon during a car accident claim that the other party will claim you share partial or complete fault for the accident. This will not prevent you from filing for compensation, but it can reduce the amount of compensation you receive. Rhode Island and Connecticut operate under a comparative fault rule. If it can be proved that you are partially at fault for the accident that caused your injury, the court will determine what percentage you are at fault for. That percentage will then be deducted from your recovery amount. For example, let’s say you were texting while driving. You failed to notice that traffic was stopping and had to slam on your brakes at the last second, which caused the car behind you to rear-end you. Even though the majority of the fault lies with the other driver, since you were breaking the law, the court finds you 20 percent at fault for the accident. Your initial recovery was $50,000, but due to the comparative fault rule, 20 percent will be deducted from that amount, resulting in $40,000 total.

Aggressive Legal Strategies And Experienced Litigators

At TJC • ESQ, we are proud of the zealous representation that we provide for our clients. After a car wreck, it is common to wonder if anyone cares about your claim as insurance companies argue over semantics and try to develop ways to avoid paying you the compensation you deserve. We would like to remind you that you should not apologize for anything. Insurance companies are well-versed in establishing blame where it might not belong, and one of the common ways they do this is by pointing the finger at the person who apologizes. Our Stamford auto accident lawyers can provide you with carefully crafted legal strategies that are focused on protecting you and your best interest.
